The filter shouldn't care if the mailing list address is in to 'to:'
or 'cc:' field of a post.

Why do you reply to the sender and cc: the list?
Because that's how e-mail (MUA to be precise) work.
(MUA: Mail user agent - pine, Outlook, Netscape Mail, Mozilla...)

The From: and Reply-To: fields contain your email address.
When repying, the MUA first looks for a Reply-To field and sends mail to
the address in this field if it exists. If only the From: field is set,
mail is sent to this address.
If a MUA does a reply-all, it first uses the above fields to determine
to which address to send the mail to. All other fields (more than
one address in the to field, any addresses in the cc: fields are set
to cc: in the reply)
In your mail above the Reply-To: field has _your_ e-mail address and
the list address is in the To: field and is thus cc'ed.
