It is the old behavior of all name servers. BIND 8 did the same. When
Verisign started to work on their name server software (Atlas,
strongly inspired by BIND 8), they copied this behavior and did not
change it afterwards.

You may find other name servers in the wild which do the same. That's
probably why Mark Andrews suggested to write code which can deal with
this behavior, even if, legally speaking, it is incorrect.
